The general terms and conditions below have also been filed with the Chamber of Commerce in Groningen under number 1270.
ARTICLE 1: Applicability of these terms and conditions. These terms and conditions apply to all sales, rental and lease agreements entered into by DJ Supply with third parties. Deviations from these terms and conditions are only valid if and insofar as confirmed in writing by DJ Supply.
ARTICLE 2: Offers. All quotations and price indications are entirely without obligation, unless stated otherwise, and are based on data provided with requests or at the time of the order. The stated prices are exclusive of VAT.
ARTICLE 3: Agreements. All agreements concluded with DJ Supply only become binding upon written confirmation from DJ Supply. Agreements only bind DJ Supply after and insofar as they have been accepted and confirmed in writing. Only the management or persons authorized in writing by DJ Supply may enter into agreements on behalf of DJ Supply. The order confirmation explicitly states: A: The goods that are the subject of the agreement. B: The sales or rental price. C: The rental period (if applicable). D: Further conditions concerning the agreement.
ARTICLE 4: Delivery. A: DJ Supply is obliged to deliver goods in the agreed condition. B: If no delivery date has been agreed upon, the goods will be delivered before the start of the rental or sales period. C: Delivery takes place at DJ Supply or at a delivery address designated by the customer, as stated on the order confirmation. D: As proof of delivery, DJ Supply provides a delivery note in duplicate, one signed copy of which is returned by the customer.
ARTICLE 5: Receipt and claims. A: The customer is obliged to accept the goods upon delivery and to immediately check them for correctness and condition. B: Any complaints must be stated on the delivery note. In the absence thereof, all claims against DJ Supply will lapse.
ARTICLE 6: Return (if applicable). A: After the rental period, the customer must return the rented goods in their original condition and packaging. B: A return receipt will be drawn up as proof of return.
ARTICLE 7: Care & risk. A: The goods are entirely at the expense and risk of the customer from the moment of delivery until return. B: The customer is obliged to report any loss, theft or damage directly to DJ Supply and to compensate for the full damage.
ARTICLE 8: Cancellation. A: The customer can cancel the agreement if this is done in writing at least 3 working days before the start of delivery. In case of cancellation within 3 working days, DJ Supply is entitled to charge cancellation costs.
ARTICLE 9: Payment. A: Payment must be made upon delivery or within the agreed payment term, without deduction or set-off.
ARTICLE 10: Compensation for late payment. A: In case of late payment, the customer is in default without notice of default. Interest of 10% per month on the outstanding amount is due from the due date.
ARTICLE 11: Applicable law. Dutch law applies to all agreements. All disputes will be submitted to the competent court in Groningen.
ARTICLE 12: Competent court. All disputes arising from agreements with DJ Supply will be exclusively settled by the court in Groningen.
